Impugned in this appeal filed by the UT of J&K is an order dated 28th May, 2022 passed by the Special Judge, Designated Court under the NIA Act (Srinagar) [“the trial court”] in case titled “State of JK Vs. Showkat Ahmad Khan & Ors.”, whereby the trial court has granted bail to the respondents in FIR No. 73/2018 under Sections 13/18/20/38/39 of the UA P Act, 395/120B RPC, 7/25 Arms Act, 30 Police Act, r/w 3 PEPO. 2. The impugned order of bail was passed by the trial court on 28th May, 2022. Almost four years have been passed, and there is no complaint by the prosecution that the respondents, being on bail, have either jumped the bail or in any manner hampered or interfered with the trial. It has submitted that the respondents have been cooperating in the trial and the prosecution has so far recorded the statements of 12 out of 22 witnesses. 3. In that view of the matter, we do not deem it a fit case to interfere with the order of grant of bail in favour of the respondents, which is impugned before us in this appeal.
