The petitioner-husband is before this Court seeking revision of the judgment dated 03.09.2021 passed by the learned Judge, Family Court, Cuttack in Criminal Proceeding No. 88 of 2020. By the said judgment, the learned Judge, Family Court has allowed the petition filed by the wife in the marriage under section 125 Cr.P.C. seeking monthly maintenance as well as litigatin expenses. The application was favoured by the learned Judge, Family Court directing payment of ₹4000/- as monthly maintenance from the date of application and ₹10,000/- as litigation cost. Thereafter by order dated 16.4.2022 learned Judge, Family Court has directed payment of arrear maintenance of ₹52,000/-. Learned counsel for the petitioner files memo of date which states thus : “The petitioner did not wants this case as petitioner and opp. party staying happily and mainte this conjugal life. Hence pray for withdraw this application.”(sic) 2. In view of the above, the petition is disposed of. 3. Copy of this order shall be forwarded by the Registry to the court of learned Judge, Family Court, Cuttack to be tagged to the case records of Criminal Proceeding No. 88 of 2020. 4.
