ORDER
06.03.2026
1. After arguing for a while, when learned counsel for the petitioner was confronted with the maintainability of the instant writ petition, he fairly submitted that he would feel satisfied in case a direction is issued to respondent No. 3 to accord consideration to the representation alleged to have been filed by the petitioner within a reasonable period.
2. A perusal of the averments made in the writ petition reveals that the petitioner has failed to point out as to how he is aggrieved by the shifting of the FPS Centre, Dhamalian, which at present is being run by respondent No. 5 uninterruptedly for the last more than fifty years. The petitioner has failed to make out a case of infringement of any legal, fundamental or statutory right which could give rise to a cause of action for filing the instant writ petition.
__________
3. When learned counsel for the petitioner was confronted with the maintainability of the instant writ petition, he sought withdrawal of the same while requesting that respondent No. 3 may be directed to decide the said representation within a reasonable period.
4. Learned counsel appearing on behalf of the official respondents is not averse to the said prayer, provided the representation is considered in accordance with law.
5. Since an innocuous prayer has been made by learned counsel for the petitioner, this Court deems it proper to dispose of the instant writ petition by directing respondent No. 3 to consider and decide the representation alleged to have been filed by the petitioner, in accordance with law, preferably within a period of four weeks from the date a copy of this order is made available to him.
