That, this Hon’ble Court may kindly be pleased to quash/set-aside the impugned transfer order dated 14.11.2022 (Annexure P-1). ii. That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to perform his duty at present place of posting. Iii. That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deem-fit and appropriate. 2. Learned counsel for the petitioner submits that the petitioner who was working as Assistant Teacher Government Primary School Aamandand Sonagara was promoted on the post of Head Master and posted at Government Primary School Sursutiyapara Block Development Pratappur, District Surajpur vide order dated 14.11.2022. That order was modified and he was posted at Government Primary Boys Ashram Jajawal Block Development Pratappur District Surajpur, CG. This Court vide its order dated 16.12.2022 stayed the effect and operation of the impugned order Annexure P-1. She further submits that during the pendency of this writ petition, the petitioner who was working as Government Primary School Sursutiyapara was under the rationalization policy of the State Government again transferred to Primary School Karihdaand vide order dated 04.06.2025. Copy of the same is placed before this Court. She further submits that challenging that order, the petitioner had filed a writ petition bearing WPS No. 11549 of 2025 and this Court was pleased to grant interim order in favour of the petitioner. 3. Learned counsel for the State/respondent submits that in fact the order impugned is no longer existence as subsequently under rationalization policy of the State Government, the petitioner has been 3 transferred to some other place which is also under challenge by the petitioner before this Court. 4. Be that as it may, as the challenge in this writ petition was the amendment in the transferred order in the petitioner by which he was placed at Government Primary Boys Ashram Jajawal Block Development Pratappur District Surajpur, CG. Vide order dated 04.06.2025, he has been transferred to Primary School Karihdaand challenge to which is pending consideration before this Court. In sum and substance the impugned order does not appear to be in existence. Thus, it is observed that the respondent/State shall not act upon the Annexure P-1. 5.
