Two persons had joined together and filed a plaint under Section 92 of the Code of Civil Procedure along with an application to grant leave to file a civil suit before the learned single Judge. The said application for grant of leave was contested by the defendants/respondents on various grounds, particularly contending that there was no locus for the plaintiffs to institute the suit and framing of the suit was born out of personal vendetta. 2. The learned single Judge, after considering the plaint and the counter in the grant to leave application, held that no reason was found to hold that the suit was filed to settle personal vendetta. The learned single Judge also recorded that the suit was filed only on public interest and the first applicant/plaintiff was the founder trustee of the first respondent Trust. 3. Being aggrieved, the Trust and the Managing Trustee have preferred this intra court appeal. This appeal has been pending since 2022. Meanwhile, it is reported that, after grant of leave, the suit has been numbered as C.S.No.177 of 2022 and, after completion of pleadings and framing of issues, examination of witnesses has commenced; two witnesses on the side of plaintiffs have already been examined and cross-examined and the matter is posted for examination of further witnesses. https://www.mhc.tn.gov.in/judis OSA No.236 of 2022 __________ Page3 of 4 4. Considering the facts and circumstances, without adverting to the merits raised in the appeal, this Original Side Appeal is dismissed, leaving open the issues raised in this appeal for consideration before the trial Court while disposing of the suit finally.
