For Petitioner: Mr.S.Muthukrishnan For Respondents: Mr.K.K.Ram Siddhartha, Additional Government Pleader (for R1 to R3) No appearance (for R4 & R5) ORDER The instant Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to pay balance of insurance amount of Rs.2,25,983/- to the petitioner as per the policy coverage for the operation performed for the petitioner in the Kovai Medical Centre as per the Health Care Scheme. 2. When the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the Madurai Bench of this Court, in a batch of Writ Petitions arising out of similar claims in W.P.(MD) No.13429 of 2013 etc., batch, dated 28.05.2018, has held that, if there is any grievance in respect of medical claim, as per G.O.Ms.No.202, Finance (Salaries) Department, dated 30.06.2016, the aggrieved person can prefer an appeal before the concerned District Level Empowered Committee, as provided under the said Government Order. https://www.mhc.tn.gov.in/judis WP No. 4263 of 2022 __________ Page3 of 5 3. In view of the ratio laid down by the Madurai Bench of this Court in S.Marimuthu v. Government of Tamil Nadu (W.P.(MD) No.13429 of 2013 etc., batch, dated 28.05.2018), the present Writ Petition is disposed of, granting liberty to the petitioner to approach the concerned District Level Empowered Committee. The petitioner is directed to prefer an appeal before the concerned District Level Empowered Committee within a period of four weeks from the date of receipt of a copy of this order. If any such appeal is received, the concerned District Level Empowered Committee shall consider the same and pass appropriate orders, in accordance with the ratio laid down by the Madurai Bench of this Court in S.Marimuthu’s case (cited supra), within a period of eight weeks from the date of receipt of such appeal. For the purpose of computing the period of limitation, the period during which the present Writ Petition was pending before this Court shall stand excluded.
