The appellant proposes to challenge the judgment and award dated 24.01.2020, passed in Motor Accident Claim Petition No. 79 of 2018, Ashok and others Vs. The New India Assurance Co. Ltd. by Motor Accident Claims Tribunal/3rd Additional District Judge, Dehradun. By it, the appellants/claimants were awarded Rs.2,25,000/- compensation alongwith interest @ 7.5% per annum. It is delayed. Delay has yet not been condoned. Heard on Delay Condonation Application No. 1 of 2022. Today, learned counsel for the appellants submits that, in fact, in the Lok Adalat, a settlement has arrived at. The respondent no.1/Insurance Company has agreed to deposit Rs.2 Lakhs before the Tribunal, therefore, the appellants want to withdraw the appeal now. Learned counsel for the respondent no.1/Insurance Company submits that the agreement has already been arrived at and within three weeks, the respondent no.1/Insurance Company will deposit Rs.2 Lakhs, which may be withdrawn by the appellants. Since delay has yet not been condoned and the parties have arrived at a settlement, the delay condonation application and the appeal is decided accordingly. (Ravindra Maithani, J.) 15.05.2026 Jitendra
