For Petitioners: Mr.P.Sivam for Mr.R.Rajarajan ORDER This petition has been filed seeking to condone the delay of 959 days in filing the second appeal. 2. The reason given for not filing the appeal in time is the Covid-19 pandemic. The judgment of the lower appellate court was pronounced on 19.03.2019. The appeal had been filed on 08.03.2022. Though the respondents have been served, they have not entered appearance. 4. While condoning the delay, I am inclined to impose a condition directing the petitioner to pay a costs of Rs.2,000/- (Rupees Two Thousand only) to the Madras High Court Clerks Welfare Association, within a period of one week from the date of receipt of a copy of this order, failing which, this petition and the appeal shall stand rejected automatically, without further reference to this Court. 5. Accordingly, this Civil Miscellaneous Petition ordered. 6. It is brought to the notice of this Court that the second respondent is no more. However, the legal representatives of the deceased second respondent are already on record as respondents 1, 3 and 4. In this regard, the learned counsel for the petitioner filed a memo dated 06.07.2026 and the same is recorded. 7. The respondents 1, 3 and 4 are recorded as legal representatives of the deceased second respondent.
