Heard the learned counsel on either side. 3. The learned counsel appearing for the petitioner submitted that the petitioner's husband was appointed in the office of the third respondent on 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.25407 of 2022 28.12.1990 and had rendered continuous service for 27 years. He attained the age of superannuation on 30.11.2017. There is no dispute with regard to the date of appointment, the date of superannuation, or the salary drawn by the petitioner's husband. After his retirement, he approached the third respondent seeking disbursement of the gratuity amount payable to him. However, despite several requests, the gratuity amount was not disbursed. Thereafter, the petitioner's husband filed P.G.No.110 of 2019 before the second respondent. By order dated 29.10.2019, the second respondent allowed the petition and directed the third respondent to pay a sum of Rs.4,09,891/-, together with interest at the rate of 10% per annum from 01.01.2018, within thirty days from the date of receipt of the order. Subsequently, the third respondent disbursed only the principal amount of Rs.4,09,891/- without paying the interest as directed. Thereafter, the petitioner's husband passed away on 25.04.2021. Hence, the petitioner, being his legal heir, has filed the present Writ Petition seeking implementation of the order passed by the second respondent in P.G.No.110 of 2019, insofar as it relates to payment of interest at the rate of 10% per annum for the period from 01.01.2018 to 28.11.2020, and for compliance with the directions issued by the first respondent in Circular Na.Ka.No.22735/2018 dated 13.01.2020. 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.25407 of 2022 4. The learned Government Advocate appearing for the respondents submitted that this Court may issue an appropriate direction to the third respondent. 5. In view of the above, this Court directs the third respondent to implement the order passed by the second respondent in P.G.No.110 of 2019, dated 29.10.2019, within a period of eight (8) weeks from the date of receipt of a copy of this order, if the said order has not already been implemented and if there is no legal impediment. 6. Accordingly, the Writ Petition stands disposed of.
