Heard both sides. 2.The petitioner alleges that the private respondents have committed encroachment in the irrigation canal passing through the petition mentioned survey numbers. 3.It is admitted that these survey numbers are patta lands. The learned counsel for the private respondents draws our attention to the judgment and decree dated 01.10.2024 made in O.S.No29 of 2022 on the file of District Munsif Court, Ilayangudi. The petitioner herein figured as the first defendant in the suit. The State of Tamil Nadu was shown as the second defendant. The said judgement does not appear to have been stayed or set aside as on date. 4.Be that as it may, Mr.Muthu Murugan, Senior Revenue Inspector, Ilayangudi informs us that the canal that is shown to be running through the patta lands in Survey Nos.7/5H, 7/2D and 7/1A is still remaining intact and that it has not been blocked by the private respondents herein. 5.Recording the said submission and directing the respondents herein to maintain the said irrigation canal running through the said survey numbers as such, this writ petition is disposed of.
