REV APLW(MD).No.22 of 2022 Mr.V.Shathurthiraja Government Advocate (Crl Side) for R.7 & R.8 ORDER (Order of the Court was made by G.R.Swaminathan J.) Heard both sides. 2.The review applicant is aggreived by the order dated 27.07.2021 made in W.P(MD)No.11033 of 2020. One Ammaiyappan had filed the said writ petition for directing the local body to take action against the review applicant. This Court disposed of the writ petition by directing the municipality to proceed against the unauthorized construction said to have been put up by the review applicant. 3.The case of the review applicant is that he has been in possession of the petition mentioned building since 1980's. Property tax has also been assessed and collected by the local body. On account of Gaja cyclone, the building suffered a damage and being a mason himself, he merely carried out repair works. The Hon'ble Division Bench, while disposing of the writ petition, made it clear that it is open to the review applicant to avail all the 3/6 https://www.mhc.tn.gov.in/judis
REV APLW(MD).No.22 of 2022 remedies set out in the Act. We do not find any error apparent on the face of record in the order passed by the Hon'ble Division Bench.
4.Be that as it may, taking note of the fact that the writ petitioner had earlier filed a civil suit against the review applicant and allowed the same to be dismissed for default, and also taking note of the claim of the review applicant that he is not in occupation of any temple land but only Government poramboke land, we permit the review applicant to approach the local authority seeking regularisation of the construction put up by him. 5.With the aforesaid liberty, this Review Application is disposed of.
