A.Tamilvanan For R2 https://www.mhc.tn.gov.in/judis WP No. 20638 of 2022 ORDER This writ petition has been filed seeking to direct the 1st respondent to record the names of the new office bearers of our association in the records of the 1st respondent herein and issue Certificate for the same as per their letter dated 4.4.2020. 2.Learned counsel for the petitioner would submit that the election of the officer bearers was conducted in the year 2019 and a new set of officer bearers were selected by the members of the petitioner Association and it was also intimated to the 1st respondent by way of their letter dated 04.04.2020. However, till date, the 1st respondent has not recorded the same in their records. He would further submit that the petitioner had conducted general body meetings continuously for the last three years with the new office bearers and this was also brought to the knowledge of the 1st respondent and the petitioner requested to record the name of the new office bearers in their records. However, the 1st respondent has not acted upon the same. Hence, the present writ petition has been filed. 3.Learned Additional Central Government Standing Counsel appearing for the 1st respondent would submit that the petitioner has to file proper resolution in proper format through online and the 1st respondent would consider the same. https://www.mhc.tn.gov.in/judis WP No. 20638 of 2022 4.Heard the learned counsel for the petitioner; learned Additional Central Government Standing Counsel appearing for the 1st respondent and the learned counsel for the 2nd respondent. 5.Considering the submissions made by either parties and in view of the limited prayer sought for in this writ petition, without going into the merits of the case, this Court directs the petitioner to file the resolution passed regarding the appointment of new set of office bearers in proper format through online. The 1st respondent is directed to take the said resolution filed by the petitioner on record and issue certificate for the same. If the petitioner is unable to understand the procedure of filing the resolution through online, the petitioner shall take the assistance of the Company Secretary or the Chartered Accountant. 6.With the aforesaid directions, this writ petition is disposed of.
