Crl.R.C.No.1694 of 2022 __________ Page2 of 4 ORDER This Criminal Revision Case has been filed as against the Judgment dated 17.08.2022 passed in C.A.No.04 of 2021 on the file of the III Additional Sessions Judge, Puducherry, thereby confirming the order dated 14.12.2020 passed in S.T.C.No.5140 of 2012, on the file of the Judicial Magistrate No.II, Puducherry, for the offence punishable under Section 138 of the Negotiable Instruments Act.
2. The learned counsel appearing for the petitioner submitted that the petitioner/accused died and, therefore, this petition is liable to be dismissed as abated.
3. The learned counsel appearing for the respondent submitted that insofar as the sentence is concerned, the charge is abated. However, insofar as the compensation is concerned, the legal heirs of the deceased accused are liable to pay the same.
4. In view of the above, this Criminal Revision Case stands dismissed as abated. However, it is made clear that the legal heirs of the deceased accused are liable to pay the compensation to the respondent.
