..Respondents Writ Petition filed under Article 226 of Constitution of India seeking for issuance of writ of Mandamus directing the respondent to disburse the statutory entitlement namely 30% solatium with interest till the day of payment, in the light of judgment of Hon’ble Supreme Court of India in the matter of Union of India and Another Vs Trasem Singh and others, in Civil Appeal No. 7064 of 2019 at 19/9/2019 by considering petitioners representation dated 29.08.2022 within time framed manner. For Petitioners: Mr,K.Sudhakar For Respondent(s): Mrs.Indhu Bala (R1) Additional Government Pleader ORDER This Writ Petition has been filed seeking a direction to the respondent to disburse the statutory entitlement namely 30% solatium with interest till the date of payment, in the light of judgment of Hon’ble Supreme Court in the case of Union of India and Another Vs Trasem Singh and others, in Civil Appeal No. 7064 of 2019 at 19/9/2019 by considering petitioners representation dated 29.08.2022 within time framed manner. 2. The learned counsel for the petitioners would submit that the petitioners land was acquired for formation and widening four/six laning of https://www.mhc.tn.gov.in/judis
WP No. 32875 of 2022 __________ Page6 of 9 roads on NH No.68 at Salem District, under the National Highways Act, 1956, for which compensation was paid to the petitioners. However solatium was not paid to them. 2.1.Further he would submit that the petitioners are entitled for solatium as per the Judgment of Hon’ble Apex Court in the case of Union of India and Another Vs Trasem Singh and others (Civil Appeal No. 7064 of 2019 dated 19/9/2019). Hence, the petitioners made a representation to the respondents on 29.08.2022, seeking to disburse the statutory entitlement viz., namely 30% solatium with interest till the date of payment. As the same did not evoke any response, the petitioners have come forward with this writ petition seeking for the aforesaid relief. 3.
In reply, the learned Additional Government Pleader appearing for the respondent would submit that the petitioners’ representation dated 29.08.2022 will be disposed of by the 1st respondent within a period of twelve weeks. 4. Heard both sides. Perused the materials available on record. 5. Considering the facts and circumstances of the case and having regard to the submissions made, this Court directs the 1st respondent to consider the petitioners’ representation dated 29.08.2022 on its own merits and dispose of https://www.mhc.tn.gov.in/judis
