Learned counsel for the petitioner would submit that the first respondent is a registered society, whose management and administration are solely governed by the By-laws of the first respondent. This being so, in the year 2019, the petitioner was elected as General Secretary in the said society. WP No. 6668 of 2022 __________ Page3 of 6 against the interests of the first respondent. This was followed by a charge memo on 06.01.2022, containing nine specific charges.
In her defense, the petitioner requested the audio and video recordings of the minutes dated 19.06.2021 and 14.11.2021. This request was subsequently declined by the President of the first respondent via a communication dated 26.01.2022. Aggrieved by this refusal and the issuance of the charge memo dated 06.01.2022, the petitioner has preferred the present Writ Petition. 3. At this juncture, learned senior counsel appearing for the first respondent would submit that a two-member disciplinary committee was initially constituted to enquire into the charges against the petitioner. However, this Court, by its order dated 25.03.2022, directed the respondents to proceed with the enquiry but instructed them not to conclude the same prior to the next date of hearing. Subsequently, during an Executive Board Meeting of the Hockey Unit of Tamil Nadu held on 25.11.2022, the Committee decided to drop all charges against the petitioner following the assumption of office by new office bearers. For better appreciation, the relevant portion of the minutes is extracted below:
“10. Not to continue with the pending disciplinary proceedings with Mrs.Renukalakshmi since the tenure of the office bearers who assumed office on 15.09.2019 shall end on 14.09.2022 including Mrs.Renukalakshmi's Secretaryship.” https://www.mhc.tn.gov.in/judis

4. Heard the learned counsel on either side and perused the materials available on record. 5. A cursory reading of the memorandum of charges dated 06.01.2022 issued to the respondent against the petitioner would reveal that all charges are relating to the scope of work of the petitioner. No charge is pertaining to the scope beyond her work. Therefore, it is clear that the petitioner had discharged the duty within the scope of her work. In such case, even assuming that the charges are proved and the same would have been within the scope of her work and thus, there is no fault on the part of the petitioner. 6.
When such being the case, keeping all the above aspects in mind, in the Executive Board Meeting of the Hockey Unit of Tamil Nadu, held on 25.11.2022, it was decided to drop all the charges against the petitioner following the assumption of office by the new Office bearers. The relevant portion of the minutes of meeting, viz., paragraph No.10, was already extracted at paragraph No.3 of this order. 7. Thus, as on date, there is no charge against the petitioner, since it was already dropped by the Executive Board as early as on 25.11.2022. Hence, the memorandum of charges issued against the petitioner is liable to be quashed. Accordingly, it is hereby quashed. https://www.mhc.tn.gov.in/judis

8. In the result, this writ petition is allowed. In view of the above order, the enquiry officers, appointed by the Committee, will also be discharged from their duties and they are entitled for remuneration for their service. No costs.
