For Petitioner(s): Mr.K.Elango For Respondent(s): Mrs.S.Anitha Special Government Pleader https://www.mhc.tn.gov.in/judis WP No. 4429 of 2022 __________ Page3 of 7 ORDER The writ petition is filed seeking writ of mandamus to direct the respondents to demolish the building constructed on Plot Nos. 18 and 19, in the approved lay-out number 178 of 2018 comprised in Survey No. 440/1B, situated at Arasur Village, Arasur Post, Sulur Taluk, Coimbatore District, Pin-641 407 and further to direct the respondents 1,7,8 and 9 to develop a park in Plot Nos. 18 and 19 in the above said lay-out as regularised in the lay-out Plan No. Ma. Va. (Ko. Vu. Thi. Ku. Regularisation No. 178/2018) and pass such further or other orders. 2. The learned Counsel for the petitioner/sangam would submit that the subject property bearing Plot Nos. 18 and 19 comprised in Survey No.440/1B, measuring 3302 sq.ft situated at Arasur Village, Arasur Post, Sulur Taluk, Coimbatore District has been earmarked for development of park. While so, the respondents 8 and 9 are carrying out illegal construction activities in Plot Nos.18 and 19. Aggrieved by which, the petitioner/sangam submitted a representation dated 08.01.2022, to the respondents requesting them to initiate action to stop the illegal construction activities and to develop Plot Nos.18 and 19 in the approved layout as park. However, no action has been taken till date. Thereafter, the petitioner/sangam submitted a representation dated 25.01.2022 to the Officials of the Electricity Department requesting them not to provide https://www.mhc.tn.gov.in/judis WP No. 4429 of 2022 __________ Page4 of 7 electricity supply connection to the building being constructed in the place earmarked for park. In response to which, the 6th respondent sent a communication to the petitioner/sangam dated 16.02.2022, informing them that they are taking steps to provide the electricity service connection. Aggrieved by which, the present writ petition has been filed. 3. At the outset, it is submitted by the learned Special Government Pleader for respondents that the representations dated 08.01.2022 and 25.01.2022, made by petitioner/sangam would be considered and appropriate orders would be passed within a time frame fixed by this Court, which was agreed to by the learned counsel for petitioner. 4. Taking into consideration the facts and circumstances of the case, the materials placed before this Court and the grievance expressed by the petitioner/sangam, there shall be a direction to the respondents to consider the representations submitted by the petitioner/sangam dated 08.01.2022 and 25.01.2022 and pass appropriate orders on its own merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 4429 of 2022 __________ Page5 of 7 5. With the above direction, the Writ Petition stands disposed of. Consequently, connected miscellaneous petition is closed.
