AJMAL ASSOCIATES for R2 https://www.mhc.tn.gov.in/judis WP No. 254 of 2022 __________ Page2 of 4 Order This writ petition is filed by the petitioner to direct the 1st respondent to conduct enquiry in the application filed by the petitioner to recover the Waqf property. 2. The case of the petitioner is that he is the President of the Mohideen Andawar Pallivasal Waqf, which is a notified Waqf, controlled by the Tamil Nadu Waqf Board. It owns several property in and around the Wafq. The dispute is that the Waqf property was illegally swindled by the 2nd respondent and his family members. Hence, the petitioner has filed Waqf enquiry application to recover the Waqf property. Till date, the 1st respondent has not taken any action to initiate enquiry proceedings. Therefore, the petitioner is before this Court. 3. The learned counsel for the petitioner submitted that the property was illegally sold out and encumbered by the 2nd respondent and his family members, which has to be recovered by the Waqf Board under due process of law. Hence, direction may be given to the 1st respondent to initiate the enquiry proceedings and dispose the same within a stipulated period of time as fixed by this Court. https://www.mhc.tn.gov.in/judis WP No. 254 of 2022 __________ Page3 of 4 4. The learned counsel for the 2nd respondent has no objection to dispose the application filed by the petitioner. 5. Heard both sides and also perused the materials available on record. 6. Considering the limited request sought for by the counsel for the petitioner, this Court directs the 1st respondent to conduct enquiry based on the application of the petitioner dated 30.11.2021 and dispose of the same and pass appropriate orders, after affording an opportunity of personal hearing to all the concerned parties, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. 7.
