No. 303, Rajaji street, Vettuvanam now controlled and managed by vettuvanam senkunthar parambarai charitable Trust, vettuvanam Anaicut Taluk, Vellore District For Petitioner(s): Mr.K.A.Ravindran For Respondent(s): Mr. S.Ravichandran, AGP (HR & CE) RR1 to 5 ORDER The writ petition has been filed forbearing the Respondents or its officials or any person claiming power or right from them either directly or indirectly interfering with the affairs and administration of the petitioners Temple viz Sree Ramar bajanai kovil Known as Vettuvanam Senkunthar parambarai bajani Kol situated in S. No. 303 / 30 and the lands in S. No. 303, Rajaji street, Vettuvanam now controlled and managed by vettuvanam senkunthar parambarai charitable Trust, vettuvanam Anaicut Taluk, Vellore District. 2. The petitioners are trustees of Sree Ramar Bajanai Koil and they are administered the said temple for the past several years and performed https://www.mhc.tn.gov.in/judis WP No. 20058 of 2022 __________ Page3 of 6 Kumbhabishegam for the Bajanai Koil. Some of the Senkunthar community people raised query about the administration of the temple. Hence, the petitioners have sent petition under Right to information Act, the respondents have not furnished the details about the affairs and administration of the said koil. The petitioner submit that they were not given any opportunity before bringing temple under the purview of Tamil Nadu HR & CE Act. Further none of the details furnished to the petitioners about the affairs and administration of the temple, The petitioner is in administration of the said koil and lock and key is under the custody of the Trustee till this date. Hence, the present writ petition. 3. The learned counsel for the petitioner submitted that the respondents have no jurisdiction to call for any application for appointment of Trustees to the petitioners temple, since it is not only religious Institution by its nature and as the same is a private temple belonging to Senkunthar Community Trust. The learned counsel further submitted that there is a duty cast upon the 4th respondent to provide all the necessary details asked for by the petitioner and the evasive reply mentioned in the letter dated 26.12.2020 and 10.02.2021 clearly indicate that HR & CE department is concealing the material facts regarding the alleged take over of the petitioner’s temple. 4. The learned counsel further submitted that the respondents have stated in the counter affidavit that already they have appointed a fit person for https://www.mhc.tn.gov.in/judis WP No. 20058 of 2022 __________ Page4 of 6 managing the temple. However, the respondents have not mentioned any details with regard to the appointment of a fit person in the counter affidavit. Hence, this Court may direct the respondents to produce a copy of the proceedings with regard to the fit person within the stipulated time as fixed by this Court to enable the petitioner to work out the remedy in the manner known to law. 5. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the materials available on record. 6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the respondent to furnish the proceedings for appointment of the Fit Person to the petitioner within a period of two weeks from the date of receipt of a copy of this order. 7. With the above direction, the writ petition is disposed of. No costs.
