[R4] i) Whether approved for No reporting in Law journals etc.: ii) Whether approved for publication No in press: Serial No. 02 Supplementary List 2026:MLHC:887 JUDGMENT: (per the Hon’ble, the Chief Justice) (Oral) By this petition, the petitioner seeks quashing of the FIR dated 09.04.2021 registered with the Phulbari Police Station and consequently, the charge-sheet filed in the said FIR and also the criminal proceeding, i.e., GR Case No. 40 of 2022 pending before the JMFC, West Garo Hills. 2. Mr. N.D. Chullai, learned AAG, on instructions submits that the petitioner has also filed a criminal revision application, being Criminal Revision No. 5 of 2025 before the learned Sessions Judge at Tura against the order dismissing the petitioner’s application seeking his discharge from the said case and the revision application is pending before the learned Sessions Judge, Tura. 3. In this view of the matter, since the revision application, filed by the petitioner is pending before the learned Sessions Judge, Tura, this Court is not inclined to entertain the aforesaid petition filed under Section 482 of the Cr.P.C. 2026:MLHC:887 4. Needless to state that, the learned Sessions Judge to decide the pending revision application on its own merits uninfluenced by the disposal of the aforesaid petition. It is made clear that this petition is being disposed of only having regard to the fact, that the petitioner has filed a revision application, which is pending for hearing before the learned Sessions Judge, Tura. 5. Needless also to state that, all contentions of all parties are kept open. 6. The petition is, accordingly disposed of. 7. All parties to act on the authenticated copy of this order.
