purpose of admission; D. Pass an Order thereby imposing exemplary costs upon the Respondents to compensate the Petitioner for the mental tension and agony caused to him;…”
3. The petitioner, a student who secured 91.75% marks in his Senior Secondary Examination, was granted admission to the two-year B.A. programme of the Respondent University against an OBC reserved seat on 07.10.2021. 4. As the OBC/NCL certificate initially submitted by him was dated prior to 31.03.2021, the petitioner submitted an undertaking on 05.10.2021, obtained a fresh certificate dated 11.10.2021 and submitted it to the respondents on 14.10.2021. Despite this, the respondents, by emails dated 23.12.2021 and 30.12.2021, alleged that the requisite certificate had not been submitted within time. 5. Thereafter, on 31.12.2021, the respondents raised a fresh ground that the petitioner's caste was not included in the Central OBC List and stated that his admission would stand cancelled. 6. The case of the petitioner is based on the fact that the petitioner is belonging to the category of Other Backward Class (“OBC”) as per Entry 11 of the Central List and had sought admission on the caste certificate in respondent No. 1/ University. 7. Since as per the respondent No. 2, there were deficiencies in the certificate, the admission of the petitioner was cancelled. Subsequently, based on an interim order by this Court dated 07.01.2022, the petitioner was permitted to continue his studies. 8. Mr.
Pathak, learned counsel for the respondent No. 2, states that the This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 19/09/2026 at 11:50:52
petitioner has finished his education and has already been awarded the provisional certificate by the college and in case the degree has not been issued, the same shall be issued in due course of time. 9. The prayer of the learned counsel for the respondent no. 2 is that the
facts of the present case should not be treated as a binding precedent.
10. The prayer of the learned counsel for the respondent No. 2 is fair and reasonable. It is directed that the case of the petitioner is in its own peculiar facts and will not be treated as a binding precedent.
11. With these directions, the petition is disposed of.
