It is stated that the applicant was incorporated as an LLP on 9th May, 2021 and has assumed the business of the petitioner no.1, which was a joint venture consortium. Vide Addendum Agreement dated 13th February, 2023, the applicant-LLP was constituted comprising M/s Sahakar Global Limited and M/s Skylark Infra Engineering 008 Private Limited. This has been recognized by MCD vide communication dated 12th December, 2023. 3. These applications have been filed by the petitioners to withdraw the present writ petitions with liberty to institute a commercial suit for recovery of the amount due along with interest against the respondent/MCD before the appropriate commercial court. 7. The petitioners claim that the benefit of Section 14 of the Limitation Act, 1963 may be granted to the petitioners for the period that the present writ petitions remained pending before this Court. 8. Mr. Sanjay Vashishtha, appearing on behalf of the respondent/MCD opposes the said request and submits that the benefit of Section 14 of the Limitation Act, 1963 can only be granted by the competent civil/commercial court where the suit is filed. He further submits that the petitioners should not be entitled to the benefit of interest for the period which the present writ petitions remained pending before this Court. 9.
