1. The present Execution Petition has been filed by the Decree Holder seeking execution of the Judgment/Decree dated 27.04.2022, passed by a co- ordinate Bench of this Court in CS(OS) 2167/2012.
2. It is stated that CS(OS) 2167/2012 was filed by the Decree Holder seeking a decree in terms of the Award dated 14.03.2007, passed by the learned Arbitral Tribunal under the Arbitration Act, 1940. It is further stated that a co-ordinate Bench of this Court vide Judgment and Decree dated 27.04.2022 modified the Award and passed a decree. It is stated that the Decree Holder filed an Appeal, being FAO(OS) 54/2022, challenging the modification in the Award. It is stated that vide Order dated 20.02.2026, the Division Bench of this Court has set aside the said decree. Meaning thereby, This is a digitally signed order. the present Execution Petition has become infructuous. Though, it is stated by the learned Counsel for the Decree Holder that the Judgment dated 20.02.2026, passed by the Division Bench of this Court, has been challenged before the Apex Court by filing Special Leave Petition (Civil) Diary No. 30794/2026 and notice has been issued in the said SLP, keeping in view the fact that the Award has been set aside, this Court is inclined to dispose of the present Execution Petition.
3. However, liberty is granted to the Decree Holder to revive the present Petition in case the Order dated 20.02.2026 is set aside by the Apex Court.
4. With these observations, the Petition is disposed of. Pending applications, if any, also stands disposed of.
