1. The present Application has been filed on behalf of the Plaintiff under
Order XXIII Rule 3 read with Section 151 of CPC, seeking withdrawal of the present Suit in terms of the settlement arrived at between the Parties vide a Settlement-Cum-Compromise Deed dated 14.08.2026 (hereinafter referred to as “Settlement Agreement”). 2. The present Suit is one for recovery of Rs.2,23,47,403/- and mesne profit from the Defendant. 3. During the pendency of the present Suit, the Plaintiff and the Defendant, with the intervention of their respective representatives and well- wishers, have amicably resolved and settled all their disputes and have entered into the Settlement Agreement. The said Settlement Agreement is reproduced in its entirety, and the same reads as under: This is a digitally signed order. 4. The Settlement Agreement is taken on record. The Settlement Agreement has been signed by all the Parties. This Court has perused the Settlement Agreement and is of the opinion that the same is lawful in nature. 5. The Parties shall accordingly be bound by the terms of the Settlement Agreement. It is made clear that any violation of the Settlement Agreement will be construed as a violation of an undertaking given to this Court and attract consequences under the Contempt of Courts Act, 1971. 6. The present Suit is disposed of in terms of the Settlement Agreement, along with pending applications, if any. 7. Let a decree sheet be drawn up accordingly. 8.
In view of the fact that the Parties have entered into a settlement and the Suit is disposed of in terms of the Settlement Agreement and in light of the of the Judgment passed by the Division Bench of this Court in Nutan Batra v. Buniyaad Associates, 2018 SCC OnLine Del 12916, and the Notification bearing No.F.14(105)/LA-2026/jtsecylaw/359-368 dated 06.03.2026 issued by Department of Law, Justice and Legislative Affairs, GNCTD, let the entire Court Fees be refunded to the Plaintiff. 9.
