The instant petition preferred under Section 482 Cr.P.C. assails the order dated 11.10.2022 (Annexure P-7) passed by the Court of Sub Divisional Magistrate, Fatehgarh Churian imposing proceedings under Section 145 Cr.P.C upon land measuring 62 kanals 2 marlas (fully described in the impugned order) situated at Berrianwal, P.S. Fatehgarh Churian, District Gurdaspur.

At the outset, learned counsel for respondent No.4 submits that after the passing of the impugned order, the eviction petition filed by respondent No.4 stands allowed by the Court of Financial Commissioner (Appeals) vide order dated 27.03.2026 and the said order has been upheld by a coordinate Bench vide order dated 07.07.2026 passed in CWP-17190-2026.

He submits that in view of the same, respondent No.4 has no objection if the present petition is allowed and the impugned order is set aside for, the petitioner shall institute separate proceedings to take possession of the land in dispute in accordance with law.

Learned counsel for the petitioner submits that he would have no objection to the same.

Keeping in view the fact that an eviction order stands passed qua the land in dispute by the Court of Financial Commissioner (Appeals) on 27.03.2026 and the same has been upheld by a coordinate Bench vide order dated 07.07.2026 passed in CWP-17190-2026, coupled with the fact that
learned counsel for respondent No.4 has submitted that he would have no objection if the impugned order is set aside, the present petition is allowed. The impugned order dated 11.10.2022 (Annexure P-7) passed by the Court of Sub Divisional Magistrate, Fatehgarh Churian is set aside.
Pending application(s), if any, also stands disposed of.
