5. During the course of hearing, it has transpired that an eviction order under the provisions of the Public Premises Act has been passed in respect of the subject property bearing Kiosk No. 62/N, H-Block, Connaught Place, New Delhi. The petitioners in W.P.(C) 392/2023 have challenged the same by way of an appeal, which is pending before the District Judge.

It was put to counsel for the petitioners that since the grounds taken in the aforesaid appeal would be similar to the grounds taken in the present writ petition, the present petition can be disposed of by granting liberty to the petitioners to raise the grounds which are taken in the petition in the pending appeal.
7. Counsel for the petitioner is agreeable to the same.

Accordingly, the present writ petitions are disposed of while granting liberty to the petitioner in W.P.(C) 392/2023 to raise the grounds taken in the present petition in the appeal which is pending before the District Judge. Liberty is also given to the petitioner in W.P.(C) 11818/2022 to either implead in the pending appeal filed by the petitioner in W.P.(C) 392/2023, or to file a fresh appeal in accordance with law.
