(Oral) The present petition under Section 482 Cr.P.C. is for quashing of FIR No.0336 dated 17.11.2022 under Section 420 IPC and 61 of the Punjab Excise Act, 1914 (Haryana Amendment Bill, 2020) and later on added Section 120 IPC, registered at Police Station Sadar Kanina, District Mahendergarh and all other subsequent proceedings arising therefrom. 2. The present FIR came to be registered at the instance of EASI Naresh Kumar and reads as under:- “To The Manager Police Station Sadar Kanina, Jai Hind, Today I ASI was present for patrolling at Village Atali alongwith C Rohit No. 182/NNL, ESI Chand Singh No. 240/NNL alongwith Private vehicle, there were secret informer informed that one person with vehicle No. HR66C0912 loading illegal liquor from Jagdish liquor house L1 with permit of Baraf liquor vend is unloading the liquor Dongra Chowk and if it is raided he can be caught. On this information I ASI alongwith employees and also requested to the VISHAL SETHI 2026.07.23 10:46 I attest to the accuracy and integrity of this document CRM-M-58327-2022 -2- persons standing there to accompany us in the raiding party but all have left by showing their helplessness. Thereafter I ASI alongwith co-employees prepared the raiding party and reached to the place disclosed by secret informer, after reaching at the place, secret informer was released and I ASI with the help of co- employee, caught one person who was unloading the liquor boxes from the vehicle which was standing backside of the liquor vendor. I ASI asked his name, he disclosed as Ankit son of Vishal R/o Indra Colony, Narnual. He almost unloaded 20 boxes of liquor then on asking of I ASI regarding the license of the liquor then he has shown three permits No. PASS No. PS222548081864 Dt. 17.11.2022 ΑΤ. 14.48.34, PASS No. PS222547081863 DT. 17.11.2022 AT. 14.37.07, PASS No. PS222562081866 DT.17.11.2022 AT. 14.50.41 JAGDISH LIQUOR HOUSE BHADAF NARNUAL,issued by Excise Department for liquor vend of Village Baraf and remaining boxes of liquor were counted and 228 boxes were found in which 15 boxes of Blenders Pride, three boxes of half bottles of Royal Green, 30 boxes of Carlsburg beer, 19 boxes of Budviser Beer, 49 boxes of Tuborg Beer, 50 boxes of Kingfiser Beer, 10 boxes of Golfershort Whisky, 5 boxes of Royalgreen, 17 boxes of Old Monk Rum, 10 boxes of Quarter bottles of old monk rum, 20 bottles of white blue whisky in total 28 boxes were found. From all boxes 1-1 was taken for sample and remaining bottles were put into the same box and sealed with HK 1-1 and after sealed same was handed over to Rohit No. 182 NLL and above said liquor alongwith pickup vehicle HR66C were taken into police possession and accused Ankit has committed offence by unloading the liquor at Dongra Chowk instead of Baraf liquor vend and committed offence under section 61-4-20 Excise H A Act 2020 and 420 IPC. Writing was sent to police station through ESI Chand Singh no. 240/ NNL, after registration of FIR information be given. The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. He is a license holder of 04 liquor vends in District Mahendergarh. On 17.11.2022 he was unloading liquor duly allotted to him at the Dongra Jatt Kalwari vend as per the Transit Slip dated 17.11.2022 (Annexure P-7). Therefore, no offence whatsoever has been committed by him and the present FIR is liable to be quashed. 4. The learned counsel for the State very fairly concedes that liquor recovered at the Dongra Chowk was as per the permit issued dated 17.11.2022. 5. In view of the above, the FIR No.0336 dated 17.11.2022 under Section 420 IPC and 61 of the Punjab Excise Act, 1914 (Haryana Amendment Bill, 2020) and later on added Section 120 IPC, registered at Police Station Sadar Kanina, District Mahendergarh and all other subsequent proceedings arising therefrom are quashed. 6.
