FIR No.93 dated 05.05.2022, under Sections 193, 205, 420, 467, 468, 471 and 120-B IPC, registered at Police Station Sector 36, District Chandigarh (Annexure P-1). Learned counsel for the petitioner submits that the petitioner is an old man of 61 years, who has been in custody for the last almost 9 months, whereas, co-accused Mewa Singh and Swaran Kaur have already been granted the concession of anticipatory bail by this Court. Learned counsel for the petitioner submits that the trial is likely to take some time and nothing is to be recovered from the petitioner and hence, he prays for grant the concession of regular bail to the petitioner. Chandigarh has vehemently opposed the grant of concession to the petitioner for the reason that he is the main accused who has played fraud upon the Court by impersonating himself as Rajesh Kumar and thereafter filing false valuation reports of the land by forging the documents and putting stamps of the office of Tehsildar, Derabassi and in fact, the FIR has been lodged at the behest of the Court itself. It is further submitted that the matter is serious in nature and such kind of person cannot granted any leverage. 4. Heard learned counsel for the parties at length. 5. Considering the gravity of offence and the fact that the petitioner had the audacity to play the fraud upon the Court by impersonating himself as Rajesh Kumar and also filing false documents with regard to the valuation of land and imposing stamp of the office of Tehsildar clearly demonstrates his mens rea to commit the crime with impunity. 6.
