1. The present Joint Application under Order XXIII Rule 3 read with Section 151 of the CPC has been filed by the Parties for passing a decree in terms of the Settlement Agreement dated 22.04.2025 entered into between the Parties before the Delhi High Court Mediation Centre. 2. The present Suit is one for partition, permanent injunction and rendition of accounts in respect of the property being B-7/90, Extension, Safdarjung Enclave, New Delhi - 110029 [“Suit Property”] left behind by Late Mr. Jaswant Singh and Late Mrs. Rajinder Kaur. It is stated that there are certain other immovable assets left behind by Late Mr. Jaswant Singh and Late Mrs. Rajinder Kaur. 3. During the pendency of the proceedings, the Parties were referred to the Delhi High Court Mediation and Conciliation Centre to explore the possibility of an amicable settlement. 4. under Order XXIII Rule 3 of the CPC have been signed by all the Parties to the Suit. The ingredients of the Application under Order XXIII Rule 3 of the CPC have been satisfied, and the affidavits have been notarised in Delhi. Though the Settlement Agreement was entered into on 22.04.2025 and the Application under Order XXIII Rule 3 of the CPC has been filed on 08.05.2025, the same was lying under defect for a period of one year. 6. This Court has perused the Settlement Agreement and is of the opinion that the same is lawful in nature. 7. The present Suit is, accordingly, disposed of under Order XXIII Rule 3 of the CPC in terms of the Settlement Agreement dated 22.04.2025, along with pending Application(s), if any. 8. Let the Decree Sheet be prepared accordingly. 9. The Parties are bound by the terms contained in the Settlement Agreement dated 22.04.2025. The parties are directed to abide by the Settlement Agreement dated 22.04.2025 and not raise any further disputes in implementing the same. 10. It is made clear that any violation of the Settlement Agreement dated 22.04.2025 would be construed as a violation of an undertaking given to the Court. 11. Since the Suit has been settled between the Parties, the Plaintiff is entitled to a refund of the entire court fees in terms of Section 16 of the Court Fees Act, 1870.
