1. The prayer in the present petition(s) bearing CWP No. 27580 of 2022 and CWP No.26699 of 2023 filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of directions to the respondents-Corporation to release the retiral dues of the petitioner such as full pension, leave encashment, gratuity and commuted value of pension and not to deduct an amount of VINAY 2026.07.20 17:54 I attest to the accuracy and authenticity of this
order/judgment
CWP-27580-2022 & CWP-26699-2023 -2- Rs.4,03,037/- from the gratuity of the petitioner on account of alleged shortage of material, respectively.
2. On 04.11.2024, the following order was passed:-
“The prayer in the present petition(s) bearing CWP No. 27580 of 2022 and CWP No.26699 of 2023 filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of directions to the respondents- Corporation to release the retiral dues of the petitioner such as full pension, leave encashment, gratuity and commuted value of pension and not to deduct an amount of Rs.4,03,037/- from the gratuity of the petitioner on account of alleged shortage of material, respectively. In the written statement filed by the respondents- Corporation in CWP-26699-2023, the following stand has been taken:-

2. That the contents of para 2 of the petition are denied being incorrect. It is wrong that even after submitting the records related with the statement of account details and material record to the Department the answering respondent-Corporation is showing outstanding amounts against the petitioner. The petitioner has been repeatedly requested vide a number of letters to supply the account statement details to the office of the answering respondent so that no due certificate may be issued to him. But despite numerous requests the petitioner has failed to provide the complete account record/receipts etc. and due to this reason the further action could not be taken. The grievance of the petitioner is totally baseless. It is respectfully submitted here that the department has released provisional pension in favour of the petitioner in the meantime."
Learned counsel for the respondent(s) submits that the petitioner may visit the office of the respondents- Corporation on any working day alongwith requisite accounts statements and material documents to reconcile the record/accounts statements etc. to enable them to issue No Objection Certificate (NOC) and to further consider the claim of the petitioner for releasing the retiral dues. Upon this, learned counsel for the petitioner submits that the petitioner will visit the office of Additional Superintending Engineer, Hakima Gate, Division PSPCL, Amritsar on 12.11.2024 at 11:00 AM for the above said purpose alongwith necessary documents. Thereafter, VINAY 2026.07.20 17:54 I attest to the accuracy and authenticity of this

CWP-27580-2022 & CWP-26699-2023 -3- necessary action shall be taken by the respondents for issuance of No Objection Certificate (NOC) and releasing the retiral dues of the petitioner accordingly. Adjourned to 02.05.2025, for further consideration. Photocopy of this order be placed on the file of other connected case.”

Learned counsel for the petitioner submits that in terms of the said order, the petitioner visited the office of the Additional Superintending Engineer, Hakima Gate, Division PSPCL, Amritsar on 12.11.2024 and submitted the necessary documents on 02.05.2025, and thereafter, No Due Certificate was issued on 09.09.2025 and thereafter his retiral benefits have been released except for the leave encashment and revised gratuity. He further submits that since the other retiral benefits of the petitioner have been released after a considerable delay, therefore, the petitioner is also entitled for grant of interest.

Learned counsel for the respondents-PSPCL submit that the claim of the petitioner for release of leave encashment and revised gratuity shall be considered and disposed of within a period of six weeks from today.
5. The petitioner shall be at liberty to make a detailed representation to the respondents for grant of interest on the delay payments, within a period of one week from today and the same shall also be considered by the respondents along with his claim of leave encashment and revised gratuity.
