1. Vide order dated 25.09.2025, this Court after going through the Status Report filed by the State has thus held as under:
“1. By the present petition, the petitioner seeks direction to the Police to provide protection for construction of boundary wall on certain land, which according to the petitioner belongs to them. 2. The details of the said land are not clear from the present petition. However, it appears that ownership over certain open land around the university area is claimed by the petitioner. 3. Status Report was filed by the State on 09.05.2023, stating that the spot in question is a service road connecting Maulana Mohd. Ali Johar Marg with the residential area of Azeem Dairy Colony & Gafoor Nagar. This is a digitally signed order. 4. The relevant portion of the Status Report is reproduced as under:
“3. That, the spot in question is a service road connecting Maulana Mohd. Ali Johar Marg with the residential area of Azeem Dairy Colony & Gafoor Nagar. The property of petitioner along with the Maulana Mohd. Ali Johar Marg is protected by the walls and iron grills. Also, the land of the petitioner also situated on both sides of the service road connecting Main Road with the residential area of the Azeem Dairy Colony and Gafoor Nagar. The portion of property of the petitioner besides the service road is also protected by walls. 4. Also, the said service road is used by the reverent coming to mian road i.e. Maulana Mohd. Ali Johar Marg and to offer prayer at the Masjid i.e. Jamia Millia Islamia Central Mosque. The petitioner is trying to construct a wall to block the service road from both sides and the intention is to merge the service road into the university campus area. 5. The residents of Azeem Dairy Colony and Gafoor Nagar have raised objections against the said contraction of wall as the wall will block their path to approach the main road as the service road is being used by the local residents for many decades.
The construction of said wall will obstruct the way of general public and the people at large shall be affected by the said walls. 6. Also, the said service road where the construction of wall is projected does not affect the security and functioning of the university anyhow. Also, the university campus is already bifurcated by main Road and metro Magenta Line of Delhi Metro. 7. The construction of wall at the service This is a digitally signed order. road is not in the interest of general public. However, the undersigned in ready to abide by any
order/directions passed by the Hon’ble Court.”
5. Considering the Status Report, it appears that there is also a dispute in regard to claim of the petitioner over the subject land.
6. Perusal of the Status Report indicates that the proposed construction of wall will obstruct the way of general public and the public at large shall be affected. It also appears from the Status Report that by constructing the wall, the petitioner may also merge some part of the public area into the University property.”
2. In view of the same, there is hardly any scope for this Court to pass any orders qua the relief sought by the petitioner in the present petition.
3. Be that as it may, the petitioner shall always be free to take appropriate remedies in accordance with law, including to approach the PS.: Jamia Nagar, if, as and when required, who shall in turn be free to take necessary action(s), also in accordance with law.
4. Accordingly, the present petition is disposed of.
