Though there is no formal Application under Order XXIII Rule 3 of CPC, however, it is stated by the learned Counsels for the Parties that the Parties have settled the disputes vide a Settlement Agreement dated 29.05.2026 (hereinafter referred to as “the Settlement Agreement”). 2. The present Suit is one for partition of the estates of Late Sardar W/C Raminder Singh and Late Smt. Verinder Kaur along with reliefs of permanent injunction and rendition of accounts. 3. During the pendency of the present Suit, the Parties were referred to the Delhi High Court Mediation and Conciliation Centre. The Parties have entered into a settlement vide the Settlement Agreement dated 29.05.2026. The said Settlement Agreement reads as under: This is a digitally signed order. Under the Settlement Agreement, it is agreed and accepted that Mrs. Anita Singh, who is the Third Party in the Agreement, would be the sole and exclusive owner of the Flat bearing No.417, First Floor, Airforce Naval Group Housing Society, Plot No. 11, Sector-7, Dwarka, New Delhi-110075. Virender Kaur, shall be owned solely and exclusively by the Second Party – Ms. Shireen Singh and other Parties will not have any claim. The Settlement Agreement also indicates that the Agricultural land measuring 4 Bighas, 17 Biswas in Khasra nos.1854/2/2, 1864/3, 1864/2, 1855/2, 1862/2 and 1862/1 situated in the Revenue Estate of Village Chattarpur, Tehsil Saket, being part of Baradari Farm, 8 South Drive, DLF Chhatarpur Farms”, New Delhi-110074 standing in the name of Late Smt. Verinder Kaur shall be solely and exclusively owned by Fourth Party - Mr. Armaan Singh and Fifth Party - Mr. Harkaran Singh. The Settlement Agreement also indicates that Parcels of land admeasuring approximately 11 hectares situated in Bilaspur also known as “Baradari Farm”, P.O. Bilaspur, District Rampur, Uttar Pradesh in the name of Late W/C Raminder Singh shall be divided between First Party - Mrs. Roopinder Singh and Third Party - Mrs. Anita Singh in equal share each. The Settlement Agreement also mentions that the First Party - Mrs. Roopinder Singh and the Third Party - Mrs. Anita Singh shall jointly take necessary steps for demarcation and consolidation of the said land in accordance with the division contained in the plan / map which is Annexure- A to the Settlement Agreement, on or before 31st December 2026 and the costs whereof shall be borne by the First and Third Parties. Under the Settlement Agreement, the Parties have also agreed that the moveable assets such as jewellery, ornaments, clothes, cash, car, National Saving Certificate, shares in various companies, money lying in Syndicate Bank, Dhaula Kuan, New Delhi, in the name of Late Smt. Virender Kaur shall be owned by Third Party - Mrs. Anita Singh solely and exclusively and the other Parties have This is a digitally signed order. At the time of signing of this Settlement Agreement the Third Party - Mrs. Anita Singh has handed over to the First Party - Mrs. Roopinder Singh, a shawl belonging to the late husband of the First Party - Mrs. Roopinder Singh. Under the Settlement Agreement, the Parties have also agreed that the property tax, electricity bills, water bills, cess and/or any other statutory/municipal outstanding, if any, in respect of the Properties till the date of the Settlement Agreement shall be borne by Third Party - Mrs. Anita Singh, Fourth Party - Mr. Armaan Singh and Fifth Party - Mr. Harkaran Singh jointly except in respect of the portion of land falling to the share of the First Party - Mrs. Roopinder Singh and Second Party - Ms. Shireen Singh under the Agreement by virtue of the division being agreed upon, which shall be the responsibility of the said First Party - Mrs. Roopinder Singh and Second Party - Ms. Shireen Singh. 5. The Parties have joined the proceedings through video conferencing and they have been identified by their respective Counsels. The Settlement Agreement has been signed by all the Parties. This Court has gone through the Settlement Agreement, the terms of which are legal and lawful and, therefore, the ingredients of Order XXIII Rule 3 of CPC are satisfied. 6. Though there is no formal Application has been filed under Order XXIII Rule 3 of CPC, however, in view of the fact that the Settlement Agreement has been signed by all the Parties, the terms of the Settlement Agreement are legal and lawful, the Parties have entered into the settlement without any influence and coercion, the Parties have read and understood the contents of the Settlement Agreement and the Parties have joined the proceedings through video conferencing and they have been identified by This is a digitally signed order. The Parties undertake that they would not deviate from the Settlement Agreement and would co-operate to ensure that the Settlement Agreement is implemented. 8. Since the Parties have entered into the Settlement Agreement, the Plaintiffs are entitled to refund of court fees in terms of Section 16 of the Court Fees Act, 1870. 9.
