Financial Commissioner dismissed the revision filed by the petitioner holding that the petitioner did not avail the statutory remedy of appeal against the order of partition dated 15.02.2020 and have straightaway filed revision before Divisional Commissioner after 4 months on 19.06.2020. 2. While issuing notice of motion on 25.02.2022, this Court observed as under:- “It is submitted that observation of the Financial Commissioner that the petitioner should have availed the remedy of appeal against the issuance of sanad is not sustainable in law. Against the sanad, only a revision petition under Section 16 of the Punjab Land Revenue Act, 1887 is maintainable. On account of this mis-interpretation of law, the Financial Commissioner has failed to examine the merits of the revision petition which was essential. Counsel for respondent is not in a position to dispute that once Sanad Taksim has been issued, the remedy was only in form of revision petition under Section 16 of the Punjab Land Revenue Act, 1887. 4. In view thereof, the impugned order dated 10.01.2022 is hereby set aside. The matter is remanded back to Financial Commissioner to decide the same afresh. Parties shall appear before the Financial Commissioner on 01.08.2026. 5. Accordingly, the present writ petition stands disposed off.
