1. By way of the present writ petition filed under Article 226 of the Constitution of India, the petitioner-workman assails the order dated 20.12.2021 passed by the learned Labour Court-IV, Rouse Avenue Courts, New Delhi in LID No.33/2017, whereby his application seeking a direction to the respondent to produce certain documents, including the attendance register and service record, was dismissed.

Learned counsel appearing for the petitioner submits that the petitioner's services were terminated on 16.08.2016 and the records sought to be produced would have a material bearing on the adjudication of his claim. Learned counsel appearing for the respondent, on the other hand, seeks dismissal of the petition by contending that the application came to be filed after the cross-examination of the respondent's witness had already been concluded.

respective evidence. Notably, some of the documents sought by the petitioner, including the service record and attendance register, were admitted in the cross examination to have been maintained by the respondent at the relevant time. Considering that the said documents may have a bearing on the adjudication of the dispute between the parties, the mere fact that evidence had already been led could not, by itself, be a ground to decline their production.
4. In view of the aforesaid facts and circumstances, the present petition is allowed and the impugned order dated 20.12.2021 is set aside. The application filed by the petitioner seeking production of the aforesaid records is consequently allowed.
5. The writ petition, along with the pending application, is disposed of in the above terms.
