1. The present petition has been filed by the petitioners under Article 226 of the Constitution of India, seeking a writ of certiorari, for quashing the speaking order dated 13.05.2022 (Annexure P-17), whereby the claim of the petitioners for appointment/enlistment as Constables has been declined. Further, a writ of mandamus has been sought for directing the respondents to appoint the petitioners as Constables on regular basis with all consequential benefits, as the petitioners were already possessing the qualification of 10+2 at the time of their regular appointment as Class IV (Group D) on 14.09.2012.
2. Learned State counsel has produced a copy of the judgment dated 06.05.2024 passed in CWP No.9624 of 2014 titled as 'Kanwaljit Singh v. State of Punjab and others' and connected cases, whereby the similar claim raised by the similarly situated persons seeking appointment on higher post after having accepting the appointment on lower post, has been rejected.
