There are seven writ petitions. Out of them, in four writ petitions, the names of the companies have already been struck off from the Registrar of Companies [RoC]. 2. The petitioners, who were the erstwhile Director, are claiming for acceptance of their resignation. However, in three writ petitions, the Corporate Insolvency Resolution Process [CIRP] proceedings are going on. The request in all these writ petitions is to direct the respondents to accept the petitioners’ resignation as a Director. 3. Learned counsel appearing for the petitioners has placed reliance on the order dated 13.09.2018 in W.P.(C) 2448/2018 (Annexure P-11). He, thus, contends that in almost similar circumstances, the Court has accepted the prayer for removal of their names from the record of the RoC. 4. Having considered the controversy involved in the writ petitions and bearing in mind the order dated 13.09.2018, the Court deems it appropriate to direct the RoC to decide the petitioners’ request with respect to four writ petitions within a period of three months from the date of receipt of a copy of the order passed today, where the names of the companies have already been struck off. 5. With respect to three writ petitions, where the CIRP proceedings are going on, let the RoC to also call upon the Resolution Professional [RP] and depending upon the submissions to be made by the RP, and respect to the This is a digitally signed order.
