JUSTICE A.GUNESHWAR SHARMA 22.6.2026 Present Mr.Thoithoi, learned counsel for the petitioner, Mr.S.Niranjan, learned Government Advocate for State respondent and Mr.Ch.Momon, learned counsel for respondent No.4, Manipur State Legal Services Authority. By the present writ petition petitioner approached this Court for a compensation of Rs.9,50,000/- (Rupees nine lakh fifty thousand) only in connection with Special Trial POCSO No.3 of 2020 which was disposed of by the learned Special Judge, POCSO, Churachandpur, as the accused expired during trial. While disposing the Special POCSO case, the learned Trial Court did not pass any final order with regard to compensation even though interim order was passed. Mr.S.Thoithoi, learned counsel for the petitioner referred to a decision of Division Bench of this court in WA No.8 of 2029 dated 6.12.2023 where applicant was permitted to approach the Manipur Legal Services Authority for compensation in terms of applicable Rules and Schemes. Mr.S.Thoithoi, learned counsel for the petitioner submits that writ petition may be disposed of by giving liberty to approach the Manipur State Legal Services Authority for compensation under any appropriate Rules and Schemes. Mr.S.Niranjan, learned Government Advocate submits that this Court may pass any appropriate order on the limited prayer made by the petitioner. Mr.Ch.Momon, learned counsel for MASLSA also submits that this Court may pass any appropriate order. This Court has considered the materials on record. The Trial Court, due to inadvertence, did not pass any order on compensation in terms of Section 33 of the POCSO Act, 2012. In the circumstance, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the Manipur State Legal Services Authority for adequate compensation with appropriate application under applicable rules and scheme. Registry is directed to send a copy of this order to Member Secretary, MASLSA for information.
