The grievance of the petitioner in the present case is non-grant of health license in favour of the petitioner in respect of its takeaway outlet ‘Khan Chacha’ situated at Shop No. 75, Ground Floor, Khan Market, New Delhi – 110003, since the petitioner did not submit a sanction plan as sought by the respondent/NDMC. 2. In this regard, reference may be made to the order passed by the predecessor Bench on 21st August, 2025. The relevant extracts from the said order are set out below: “3. Learned counsel appearing for respondent-New Delhi Municipal Council (“NDMC”) draws the attention of this Court to the Office Order dated 11th December, 2023, issued by the Health Licensing Department, NDMC, with respect to grant of Health License, and in particular relies This is a digitally signed order. By relying upon the aforesaid, learned counsel appearing for the NDMC submits that for grant of a Health License, a party is required to submit either a sanction plan, approved site plan or a built/site plan of the premises/establishment, duly signed by an architect registered with the Council of Architecture. 5. Learned counsel appearing for the respondent-NDMC further submits that there are various documents listed in the Office Order dated 11th December, 2023, which are required to be submitted for the purpose of grant of a Health License. 6. In response, learned counsel appearing for the petitioner draws the attention of this Court to para 9 of the counter affidavit, filed on behalf of respondent-NDMC, which reads as under: 7. He, thus, submits that as per the respondent itself, there is no sanction plan of the property in question. 8. Accordingly, he submits that the petitioner shall approach the NDMC with regard to submitting the site plan/built plan, duly signed by the architect, and other documents.” 3. Counsel appearing on behalf of the respondent/NDMC submits that pursuant to the aforesaid order, health license has been granted in favour of the petitioner on 9th January, 2026. 3.1. A copy of the same has been supplied to the counsel for the petitioner. 4. In view thereof, the present petition stands satisfied and is disposed of.
