Contd…/- O R D E R [1] Mr. N. Jotendro, learned senior counsel assisted by Md. Abdul Baqee Khan, leaned counsel appeared for the petitioner; Mrs. Ch. Sundari, learned GA appeared on behalf of respondents No. 1 and 2 and Mr. H. Chandrakumar, learned counsel appeared on behalf of respondent No. 3 through VC platform. [2] The present writ petition has been filed with the prayer for quashing and setting aside the order dated 28-08-2012 issued by the Additional Chief Secretary, TA & Hills, Government of Manipur, notifying that the respondent No. 3 viz., Shri Ningmei Kamei is the Ex-Officio Chairman of Charoichagotlong Part-II Village under Nungba Sub-Division of Tamenglong District in exercise of the power conferred under Section 3(4) of the Manipur (Village Authorities in Hills Areas) Act, 1956. [3] After arguing at length, the learned senior counsel appearing for the petitioner submitted that the writ petitioner has already filed a Civil Suit against the respondent No. 3, which is registered as O.S. No. 10 of 2014, before the Court of Civil Judge, Junior Division, Tamenglong, challenging declaration of the respondent No. 3 as the Khullakpa of the said Charoichagotlong Village Part-II and the said Civil Suit is still pending. The learned senior counsel further submitted that he has received instruction from the petitioner to withdraw this writ petition with liberty to challenge the impugned order dated 28-08-2012 issued by the Secretariat: TA & Hills Department before the appropriate forum. -2- WP(C) No. 262 of 2022 & anr.
