Date of order : 13.03.2026 BEFORE HON’BLE THE CHIEF JUSTICE MR. M. SUNDAR (ORDER) [1] This consent order will now dispose of the captioned transfer petition. [2] In the hearing today, Mr. N. Suresh, learned counsel on record for lone transfer petitioner and Mr. Kh. Kashi Anand, learned counsel on record for all the 15 respondents led by Senior Advocate, Mr. Th. Ibohal are before this Court. [3] Nucleus of the captioned transfer petition is a original civil suit, being ‘O.S. No. 9 of 2016 now on the file of learned Civil Judge Senior Division, Tamenglong’ (‘said suit’ for the sake of convenience). To be noted, said suit is for recovery of a sum of Rs. 50,00,000/- (Rupees Fifty Lakhs). [4] The ‘lone transfer petitioner’ before this Court is the ‘plaintiff’ in said suit and the ‘respondents’ in the captioned transfer petition are ‘defendants’ in said suit. Page 4 of 5 [5] After some arguments and after some inter se discussion, learned counsel for transfer petitioner, learned counsel for respondents and learned senior counsel appearing on behalf of the counsel on record for respondents very fairly submitted in unison in one voice that said suit can now be transferred from the file of learned Civil Judge, Senior Division, Tamenglong to the Court of Civil Judge Senior Division, Imphal East. This Court places on record its appreciation for the fair stand taken by learned counsel on both sides and learned senior counsel. [6] Before writing the operative portion of this order, this Court deems it apposite to write the following: i) This order shall not be construed as any negative opinion, reflection on the judicial officer serving as learned Civil Judge, Senior Division, Tamenglong; ii) The transferee Court i.e., Court of Civil Judge, Senior Division, Imphal East shall now proceed with the said case from the point at which it stands today i.e., the point at which it is being transferred. To be noted, this Court is informed by learned counsel on both sides that pleadings are complete and said suit is at the stage of framing of issues; iii) As this is a consent order, it is made clear that this Court has not expressed any view or opinion one way or the other on the grounds raised in the transfer petition, the counter points raised by respondents in the counter affidavit and the response of transfer petitioner vide reply affidavit of the transfer petitioner. Page 5 of 5 [7] Civil suit being O.S. No. 9 of 2016 pending on the file of the Court of learned Civil Judge Senior Division, Tamenglong shall now stand transferred to the Court of Civil Judge Senior Division, Imphal East and the Court of learned Civil Judge Senior Division, Tamenglong, shall transmit/send all records of the said suit to the transferee Court, namely, Court of Civil Judge, Senior Division, Imphal East forthwith. [8] Captioned transfer petition disposed of as allowed vide instant consent order in the aforesaid manner with observations and directives as above. There shall be no order as to costs.
