Present Mr.Ajoy Pebam, learned counsel for the petitioner and Mr.S.Niranjan, learned Government Advocate for the State respondents.
It is submitted at the Bar that parties have settled their case vide proceeding dated 12.3.2026 in the High Court Mediation Centre, High Court of Manipur. It is submitted that the writ petition may be disposed of in terms of the settlement in Mediation Proceedings dated 12.3.2026. Copy of mediation proceeding dated 12.3.2026 is reproduced as below.
“
SETTLEMENT AGREEMENT This Settlement Agreement is entered into BETWEEN Maisnam Jelly Singh, aged about 65 years, S/o (L) Maisnam Bidhu Singh, Sagolband Meino Leirak Maisnam Nongthomba Leikai, P.O. & P.S. Lamphel, District Imphal West, Manipur (Hereinafter called as
"THE FIRST PARTY") on One Part. AND (i) The State of Manipur represented by its authorized competent Officer, Govt. of Manipur, its Office at Secretariat Complex, Babupra (now at Mantripukhri), Imphal Manipur (Hereinafter called as "THE SECOND PARTY") and (ii) The Sub-Divisional Officer, Lamphel, Govt. of Manipur, its Office at Lamphelpat, P.O. & P.S.
Lamphel, Imphal West District, Manipur (Hereinafter called as "THE THIRD PARTY PARTY") on Other Part. WHEREAS
1. The First Party filed W.P(C). No. 514 of 2022 before the Hon'ble High Court of Manipur against State of Manipur represented by the Secretary/Commissioner,(Revenue), Govt. of Manipur and 3(three) other. The said writ petition was referred to the High Court of Manipur Mediation Centre vide an
order dated 28.07.2025 passed by Hon'ble Mr. Justice A. Guneshwar Sharma. 2. The High Court Legal Services Committee, High Court of Manipur appointed Shri Aribam Gautam Sharma, Advocate as Mediator for conducting mediation in connection with W.P(C). No. 514 of 2022 on 07.08.025. 3. Six mediation sessions were held with the parties and their respective counsels on 20-08-2025, 30-08- 2025, 08-09-2025, 13-11-2025, 09-02-2026 and 12- 03-2026. The Parties, with the assistance of the Mediator, and proactive participation of the Counsels for the Parties, have voluntarily arrived at an amicable solution. 4. The Parties hereto confirm and declare that they have arrived at this Settlement Agreement voluntarily, and of their own free will. 5. The following settlement has been arrived at between the Parties hereto:
a. The Second Party agreed that the Third Party shall initiate the process for reconstruction of the land records of Late Maisnam Bidhu Singh who is the father of the First Party as per old land records of the Homestead land under Patta No. 379 (old) corresponding to New Patta No. 957 covered by C.S. Dag No. 1340 measuring an area of 0.50 acres of Village No. 85-Sagolband. b. The Third Party has also agreed to reconstruct the land records of Late Maisnam Bidhu Singh who is the father of the First Party as per old land records of the Homestead land
under Patta No. 379 (old) corresponding to New Patta No. 957 covered by C.S. Dag No. 1340 measuring an area of 0.50 acres of Village No. 85-Sagolband. C. The Third Party will take up a fresh Partition Case and will pass an appropriate Order for distribution and partition of the Homestead land under Patta No. 379 (old) corresponding to New Patta No. 957 covered by C.S. Dag No. 1340 measuring an area of 0.50 acres of Village No. 85-Sagolband on the following manner :
A- Common portion for deity for 3 (three sons) – 0.051 acre B- Common Approached Road
- 0.065 acre C- Maisnam Ningol Tampakleima Devi -0.084 acre D- Maisnam Gyaneshore Singh - 0.10 acre E - Maisnam Mohen Singh
- 0.10 acre F - Maisnam Jelly Singh
- 0.10 acre
Total area= 0.50 acre d. The Third Party and his sub-ordinate Staffs shall conduct a fresh demarcation and issue a Memorandum for demarcation and partition of the above mentioned respective share.
e. The Third Party shall prepare and issue the separate Jamabandi Patta of the above mentioned respective share. f. The First Party shall arrange all necessary appearances when the other parties are required while executing the above mentioned conditions by the Third Party. g. It has been agreed that the aforesaid Writ Petition filed before the Hon ble High Court of Manipur against by the First Party against the Second Party and his Officials shall be disposed of in terms of this Settlement. h. Both the Parties shall pray to the Hon'ble High Court of Manipur that the present W.P(C) No.514 of 2022 may be disposed of in terms of the present Settlement Agreement. 6. That the parties undertake before the Hon'ble Court to abide by the terms and conditions set out in the
agreement and not to dispute the same hereinafter in future. The parties further agree and undertake that they shall not resile from the present Settlement Agreement.”
In terms of settlement in mediation proceedings, the writ petition is disposed of. Any interim order merges with the final
order.
