A common question which entails in the present batch of matters is whether the accused is entitled to be supplied with the unrelied documents. 2. In this backdrop, this Court passed the following order on 28.08.2024:- “An adjournment has been sought on behalf of the petitioner on the ground that Criminal Appeal No.1622/2022 titled as Sarla Gupta and Anr. Vs. Directorate of Enforcement is pending before the Supreme Court, which is likely to be listed on 04.09.2024.” 3. Similarly, this Court also passed the subsequent order 05.05.2025 as under:- “2. At request of learned counsel for the parties, re-notify on 16.09.2025, to await the decision in Criminal Appeal No. 1622/2022 pending before the Hon’ble Supreme Court.” 4. Today learned counsel for the parties have handed over a copy of judgment dated 07.05.2025 passed by the Hon’ble Supreme Court in Criminal Appeal No.730/2024 entitled ‘Sarla Gupta & Another vs. Directorate of Enforcement’ and submit that the sole issue involved in the present proceedings is now to be adjudicated by the learned Trial Court(s) based thereon. As such, it would be in the interest of justice to remand the present proceedings for fresh adjudication. 5. Accordingly, the present proceedings are remanded back to the learned Trial Court(s) for fresh adjudication by the learned Trial Court(s) based on the dicta rendered by the Hon’ble Supreme Court in Sarla Gupta & Another vs. Directorate of Enforcement (supra). 6.
