Learned counsel for the petitioner submits that as many as 50 dates have been passed before the learned Trial Court since and from the year 2018 to the year 2025. He has handed over a table depicting year wise bifurcation of the same as under: Serial No. Year No. of Dates

Learned counsel for the petitioner further submits that the respondents are neither discharging their admitted liability nor they are letting the trial proceed inasmuch as out of the aforesaid 50 dates, the respondents are either seeking exemption from their appearance or not appearing/ participating. So much so, Bailable Warrants as well as Non- bailable warrants had been issued on various occasions.
3. Though notice in the present petition has not been served to the respondent no.1 and 2 till date, however, considering the timeline, facts and circumstances involved, and based on the submissions made by
learned counsel for petitioner, the learned Trial Court is requested to make effort for adjudicating and disposing of Complaint Case being Ct. Case No-11161/2018 entitled “Paam Eatables Ltd. Vs. Rudra Buildwell Construction Pvt. Ltd. & Ors” within a period of one year or before, in accordance with law, without granting any unnecessary adjournments. Needless to say, learned counsel for the parties are also called upon to cooperate by not seeking unnecessary adjournments.
4. Accordingly, the present petition is disposed of in terms of the above.
