This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- “1. Direct the main respondent no. 1 to not demolish the concerned jhuggis without following the due process of law. 2. Direct main respondent no. 1 to conduct a survey of the affected residents and rehabilitate them in accordance with the Delhi JJ slum Rehabilitation and Relocation Policy, 2015; 3. Direct main respondent nos. 1 to stay the eviction of residents and their belongings at Subash Camp, New Delhi- 110044. This is a digitally signed order. Direct the respondent no. 4 to provide protection against any demolition to the residents until expressed order from the Court. 5. Direct main respondent nos.1 and 2 to pay the petitioner an amount of Rs. 80,000/-(Rupees Fifty Thousand Only) as the cost of mental agony and undertaking the legal proceedings by way of this petition. …” 2. Ms. Kaur, learned standing counsel for the Delhi Development Authority (“DDA”), has drawn my attention to the short affidavit on behalf of the DDA and more particularly paragraph Nos. 4, 5 and 6, which read as under:- “4. I say that Subhash Camp, NTPC Badarpur is a Notified jhuggi-jhopdi clusters, which appears at Serial No. 552 of DUSIB’s list. 5. That it is respectfully submitted that the demolition program which was carried out on 29.03.2023 was carried out outside the boundary of the Subhash Camp notified jhuggi clusters. Before the said demolition was carried out, a detailed exercise was carried out on 12.08.2022 whereby demarcation of boundary of Khasra No. 20 and 21 were marked by TSM Method and verified by Land Management Dept. of DDA. Furthermore, another exercise was carried out to superimpose the shape file received from DUSIB on a satellite image/Google Earth image to verify the boundary of the Notified Jhuggi cluster. Copy of the Google Earth image is annexed herewith and marked as Annexure R-1(colly). This is a digitally signed order. The said Google Earth image marks Khasra No. 20 and Khasra No. 21, which are the Khasras of the water body. However, Khasra No. 20 lies inside the boundary of the notified cluster titled Subhash Camp, and therefore no demolition was carried out there on 29.03.2023. Furthermore, the demolition was carried out for structures that were falling in Khasra No. 21, which lies outside the notified cluster. It is submitted that there is a rasta between Khasra No 20 and 21.” 3. Hence as per the DDA, the jhuggis which were beyond the indentified jhuggi cluster, have already been demolished and the jhuggis which fall inside the boundary of the jhuggi cluster and are identified in the list prepared by Delhi Urban Shelter Improvement Board (DUSIB) will only be demolished after the scheme of rehabilitation is fully implemented. 4. In view of the said stand of the DDA, Mr. Kamei, learned counsel for the petitioner, does not press the present petition. 5.
