1. Learned senior counsel appearing for the appellant as well as learned counsel appearing for the WBSIDCL hand over the copy of a communication by the appellant to the Managing Director of the WBSIDCL recording the terms of settlement mutually arrived at by the parties. As per the same, compensation of Rs.46,04,000/- has been offered by the WBSIDCL to the appellant as a condition for disposal of the appeal.

2. The said compensation is divided under two sub-heads, being Rs.4,44,000/- towards the machinery lying at the premises and Rs.41,60,000/- towards the value of the three-storied building standing thereon.
3. Although in the letter, the time for payment of the amount has been stipulated as 21 days from the date of communication of the letter,
learned counsel appearing for the WBSIDCL, on instruction, submits that 30 days from this date be given to the WBSIDCL, to which learned senior counsel appearing for the appellant, on instruction, agrees in principle. Learned senior counsel further submits that the appellant is agreeable to the quantum of compensation offered by the WBSIDCL.
4. In view of the aforesaid settlement arrived at by the parties, MAT 281 of 2022, along with CAN 1 of 2022 and CAN 2 of 2026 are disposed of in terms of the letter dated August 21, 2026, which is handed over today and be made a part of the records.
5. The interim order granted earlier on January 06, 2026, restraining the respondents from dealing with the subject plot in favour of third parties, shall continue till payment of the agreed compensation amount of Rs.46,04,000/- in terms of the agreement arrived at between the parties and shall stand automatically vacated upon such payment being made by the WBSIDCL to the appellant.

6. Subject to such payment, the parties shall not have any further claim against each other insofar as the subject-matter of the present appeal is concerned.
7. There will be no order as to costs.
8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
