Union of India and others ...Respondents ********** CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 24th August, 2026 Present : Advocate for Petitioners : Mr Pappu Sreenivas (through VC) for Mr Thirumala Rao Advocate(s) for Respondent(s) : Mr T Niranjan (Deputy Solicitor General of India), Mr C Upendra for Ms Tata Venkata Sridevi [Standing Counsel for Dr.NTR University of Health Sciences] LISA GILL, CJ: Prayer in this writ petition is as under: ‘a) Declaring the action of the Respondents 2 and 3 in continuing with the prescriptions of Paragraph 4 of G.O.P.No.646, dated 10th July, 1979 (Presidential Order) and in treating Citizens born in the State as non-local candidates for the purpose of admission into Educational Institutions NEETPG Post Graduate Medical admissions and depriving the petitioners of an equal opportunity of availing a seat in Post Graduate Medical Courses for the academic year 2022-2023 as local candidates in the State of Andhra Pradesh on par with their fellow citizens of the State as illegal, arbitrary, discriminatory and violative of Articles 14, 15, 19 and 21 of the Constitution of India and; 2 HCJ & CGR, J WP_26014_2022 b) Declare the prescriptions of Paragraph 4 of G.O.P.No.646, dated 10th July, 1979, (Presidential Order) in treating candidates born in the State as non-local candidates for the purpose of admission into Educational Institutions as arbitrary and grossly violative of Article 15(1) of the Constitution of India; and also repugnant to the Andhra Pradesh Educational Institutions (Regulation of Admissions) Amendment Order, 2016 issued vide G.O.Ms.No.132, GA (SPF&MC) Department, DT:13.06.2016; and c) Declare the Prospectus Notification DT: 12.08.2022 for the academic year 2022-23, issued by the 5th respondent University to the extent of prescribing study of undergraduate MBBS course as local candidate criteria for in-service candidates so as to exclude the in-service candidates serving in the State of Andhra Pradesh as illegal, without jurisdiction; and grossly inconsistent with the Andhra Pradesh Educational Institutions (Regulation of Admissions) Amendment Order, 2016 issued vide G.O.Ms.No.132 GA (SPF&MC) Department, DT: 13.06.2016, and consequently quash/set aside Prospectus Notification DT: 12.08.2022 issued by the 5th respondent University for the academic year 2022-23; and d) Consequently direct Respondents 2 and 3 to implement the Andhra Pradesh Educational Institutions (Regulation of Admissions) Amendment Order, 2016 issued vide G.O.Ms.No.132, G.O.Ms.No.133, GA (SPF&MC) Department, DT:13.06.2016, and Circular Memo.No.4136/SPF&MC/2015-5, DT:08.08.2016, issued by State Government of Andhra Pradesh based on Proceedings in No.F.No.21013/01/2015-SR, DT:09.06.2016 issued by the 1st respondent Government of India, while considering the petitioners as local candidates for NEETPG Post Graduate Medical Admissions for the academic year 2022-2023..’ 2. Learned counsel for petitioners fairly submits that adjudication upon the issues as raised are rendered academic due to efflux of time. 3. Writ Petition is, accordingly, disposed of as infructuous with questions as may be arising kept open for adjudication in appropriate proceedings.
