JUDGMENT:-(per Hon’ble Sri Justice Ravi Nath Tilhari)
Heard Sri M.Pitchaiah, learned counsel for the contempt petitioner, Sri Ramalingeswara Rao Kocharlakota, learned counsel for the respondent No.3, Sri G.Raju, learned counsel for the respondent No.7, and Sri P.Nagaraju, learned counsel for the respondent No.9
2. This contempt case has been filed alleging willful disobedience on the part of the respondents in implementing the order dated 12.07.2021 passed by a Co-ordinate Bench of this Court in W.P. No.1448 of 2015. 3.
The operative part of the order reads as under:
"Accordingly, the Writ Petition is allowed setting aside the order of the Tribunal and directing the petitioner to be regularized by extending the benefit of G.O.M.No.212, dated 22.04.1994 within six weeks from date. The petitioner shall not, however, be entitled to arrears of salary and other emoluments on account of such regularization save and except his services on and from 25.11.1993 shall be reckoned for the purpose of pension and other pensionary benefits.”
4. It is evident from the aforesaid order that the direction was to regularize the services of the petitioner with effect from 25.11.1993, which shall be reckoned for the purpose of pension and other pensionary benefits. 4 (RNT,J & KSR,J CC. NO.666 OF 2022)
However, the petitioner was not entitled to arrears of salary and other emoluments on account of such regularization. 5. A counter-affidavit has been filed by the respondents, enclosing a copy of the proceedings of the Superintending Engineer, Irrigation Circle, Eluru, dated 05.02.2025, vide Proceedings No. SE/IC/ELR/AB/EC- 2/E.13/82877, under which, the services of the petitioner have been regularized with effect from 20.08.2021, while his services from 25.11.1993 shall be reckoned for the purpose of pension and other pensionary benefits. 6. There is no dispute with regard to the issuance of the aforesaid proceedings. 7. In view thereof, we are of the considered view that the direction issued by this Court with regard to regularization of the services of the petitioner has been complied with. 8. However, learned counsel for the contempt petitioner raised a grievance with regard to the fixation of pension and other retirement benefits, with reference to the pay slips issued by the Government of Andhra Pradesh. 9. The petitioner is still in service. 10. In the event of any grievance with regard to pension and other pensionary benefits at the time of his retirement, or any violation of the order

of this Court, the petitioner is at liberty to work out his remedies in accordance with law. 11. The Contempt Case is closed, with the aforesaid liberty. . No order as to costs.
