Barman, learned counsel for the petitioner at the outset submits that during the pendency of the present proceeding, the departmental proceeding instituted against him was taken to its logical conclusion and the Disciplinary Authority of the petitioner, vide order dated 28-02-2022, had imposed upon him a penalty of dismissal from service. Mr. Barman submits that a copy of the said order was received by him through the affidavit filed by the respondent No. 3. He submits that now a penalty having been imposed upon him, he be permitted to withdraw the present writ petition with liberty to re-file the same by also assailing the order of penalty dated 28-02-2022. The prayer is not objected to by Mr. R. Dhar, learned Addl. Sr. Govt. Advocate, Assam.
