The grievance of the petitioners in the instant writ petition is against the action of the respondent Nos.2 to 4 in issuing the D-Form Patta in favour of respondent Nos.5 to 12 over the subject land of an extent of Ac.9.21 cents in Sy.Nos.265-1A & 265-1B at Nagasamudram Village, C.K.Palli Mandal, Sri Sathya Sai District. 3. It is contended that the subject lands are private patta lands of the petitioners. It is contended that the petitioners paternal grandfather and one Sri Vangipuram Narasimha Charyulu jointly purchased an extent of Ac.0.54 cents of land under a Registered sale deed bearing No.1151/1947 dated 22.08.1947. Since then, they were in possession and enjoyment of a property for a decade. Thereafter, Sri Vangipuram Narasimha Charyulu relinquished his right vide registered relinquishment deed bearing No.112/1956 dated 19.06.1956 relinquishing his right in favour of Kuntala Nalapa, the petitioner’s grandfather. Subsequently, on 14.08.1976, the original owner Sri Vangipuram Narasimha Charyulu sold an extent of Ac.9.21 cents in Sy.Nos.265-1A & 265- 1B at Nagasamudram Village, C.K.Palli Mandal, Sri Sathya Sai District in favour of the petitioner’s grandfather under an unregistered sale deed and 4 delivered the possession of the property. Since then, he was in possession of the property and his name was mutated in the revenue records such as RH etc. After the death of the petitioners’ grandfather, the petitioners’ father has succeeded to the subject property as his legal heir and was in possession and enjoyment of the same. After his demise, the petitioners herein have succeeded to the subject property and have been enjoying the same. 4. However, unofficial respondent Nos.5 to 12 have interfered with the petitioners possession over the subject property. It is contended that respondent Nos.3 and 4 granted D-Form patta in favour of unofficial respondent Nos.5 to 12 and issued pattadar passbooks in their favour without verifying the documents. On the basis of the said pattas, the unofficial respondents are claiming rights over the subject property and are interfering with the petitioners’ possession. Hence, the instant writ petition is filed. 5. The 4th respondent filed a counter affidavit stating that there is no record to show that respondent Nos.5 to 12 were granted assignment in respect of the subject property. However, pattadar passbooks were issued in their favour without any documentary evidence, and steps have been taken to rectify the grant in favour of respondent Nos.5 to 12. 6. In the light of the statement made by the Tahsildar in the counter affidavit that steps have been taken to correct the mistakes and undo the incorrect grant of pattadar passbooks in favour of respondent Nos.5 to 12. This Court deems it appropriate to dispose of the writ petition by directing the 5 4th respondent to pass appropriate orders in the said regard, in accordance with law, as expeditiously as possible, after affording due opportunity of hearing to the petitioners and unofficial respondent Nos.5 to 12. 7. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
