PUBLIC PROSECUTOR (AP) The Court made the following: SRK, J Crl.P.No.3855 of 2022 3 O R D E R This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the petitioner herein/Accused No.3, to quash the proceedings in FIR No.300 of 2020 of Orvakal Police Station, Kurnool, registered against the petitioner herein/A3 and other accused, for the offence punishable under Section 34 (a) of the Andhra Pradesh Excise Act, 1968. 2. When the matter is taken up for hearing, learned Special Assistant Public Prosecutor for State, on written instructions, submits that after filing of the present Criminal Petition, the police completed investigation in the above said crime and filed Charge Sheet and the case was taken on file as Calendar Case No.3125 of 2022 on the file of the Judicial Magistrate of First Class-cum-Special Mobile Court, Kurnool, and that the accused faced the trial and they were acquitted of the charge punishable under Section 34 (a) of the Andhra Pradesh Excise Act, 1968 vide Judgment dated 13.08.2025 passed by the Judicial Magistrate of First Class-cum-Special Mobile Court, Kurnool and in view of the same, the cause in the Criminal Petition does not survive for adjudication, rendering the Criminal Petition infructuous. SRK, J Crl.P.No.3855 of 2022 4 3. Recording the said submission, the Criminal Petition is dismissed as infructuous.
