W.P.No.15922 of 2023 is filed declaring the action of the Respondent-authorities in not considering the Petitioner’s application dated 20.10.2019 for pursuing Master of Information Technology and Systems in Australia and releasing the scholarship amount granted under “Ambedkar Overseas Vidhya Nidhi’ under G.O.Ms.No.54 Social Welfare (Edn.2) Department, dated 28.06.2013 as illegal and arbitrary. 36. W.P.No.28664 of 2023 is filed declaring the action of the Respondent-authorities in not considering the Petitioner’s application dated 11.12.2019 for pursuing MBBS in Bukovina State Medical University, Teatralna AQ Chernivtsi Ukraine and releasing the scholarship amount granted under the scheme of ‘Overseas Education Scheme’ under G.O.Ms.No.33 Minority Welfare (EDM) Department, dated 29.09.2016 as illegal and arbitrary. 37. As the issue in all these writ petitions is common, with the consent of learned counsel, the matters were taken up for hearing and are disposed of by this common order. 112 38. Factual background: The State Government had issued G.O.Ms.No.54, Social Welfare (Edn.2) Department, dated 28.06.2013 and introduced the ‘Ambedkar Overseas Vidya Nidhi’ scheme with an intention to provide better education to meritorious SC students in Foreign Universities. As per the guidelines, students with minimum 60% marks or equivalent grade in foundation degree / PG in Engineering / Management / pure Sciences / Agriculture Sciences / Medicine and Nursing / Social Sciences / Humanities and whose income is less than Rs.2.00 lakhs per annum is eligible to apply under the said scheme to pursue Post Graduation or Ph.D Courses in USA, UK, Australia, Canada and Singapore. 39. Subsequently, G.O.Ms.No.77 Social Welfare (Edn.2) Department, dated 06.12.2014 was issued making certain modifications by including 10 more countries for pursuing higher education by permitting one and one and half year diploma courses including MBBS in China, Philippines and Kazakistan countries. Thereafter, G.O.Ms.No.29 Social Welfare (Edn.2) Department, dated 19.05.2015 was issued enhancing minimum family income from Rs.2.00 lakhs to Rs.6.00 lakhs per annum 113 and the minimum percentage of marks for PG course for Medicine from 60% to 55%. 40. Thereafter, G.O.Ms.No.36, Social Welfare (Edn.2) Department, dated 30.03.2016 was issued bringing certain modifications. Later, G.O.Ms.No.93, Social Welfare (Edn.2) Department, dated 25.06.2018 was issued enhancing financial assistance from Rs.10 lakhs to Rs.15.00 lakhs. 41. Similarly, G.O.Ms.No.33, Minorities Welfare (EDM) Department, dated 29.09.2016 was issued to provide higher quality education to meritorious minority students in foreign Universities. Thereafter, G.O.Ms.No.55, Minorities Welfare (EDM) Department, dated 03.07.2018 was issued enhancing the financial assistance to the minority students from Rs.10.00 lakhs to Rs.15.00 lakhs. 42. Similarly, G.O.Ms.No.16 Backward Classes Welfare (C) Department, dated 17.05.2016 was issued for implementation of schemes to Kapu, Telaga, Balija & Ontari communities and G.O.Ms.No.29 Backward Classes Welfare (B) Department, dated 27.08.2016 was issued providing ‘NTR Videshi Vidyadarana’ scholarship scheme to BC students for pursuing Higher studies in 114 Post Graduation in Foreign Universities from the year 2016-17. 43. G.O.Ms.No.1 Tribal Welfare (Edn.2) Department, dated 17.01.2015 was issued introducing ‘Ambedkar Overseas Vidya Nidhi’, Financial Assistance to ST students for pursuing Higher Studies in Post Graduate Courses in Foreign Universities. 44. As there were certain flaws in the implementation of the schemes, the Government had revamped the selection process and other criteria for grant of financial assistance vide G.O.Ms.No.39 Social Welfare (EDN.) Department, dated 11.07.2022. The said G.O. is applicable to the students of SC/ST/BC/Minority/EBC including Kapu for Higher studies in Top 200 Universities abroad. As per the said G.O., the financial assistance was sanctioned to the eligible students, who get admissions in any of the top 200 Universities as per the latest QR world University rankings and the scholarship amount was enhanced to 100% of tuition fee for the students selected in the top 100 institutions/Universities. As regards 101 to 200 Institutions/Universities, the selected students were entitled to 50% of tuition fee or Rs.50 lakhs, whichever is less. The amount is to be paid in four installments and the financial assistance 115 under the scheme is given to eligible students to pursue post graduation/Ph.d courses. The income criteria were enhanced to Rs.8.00 lakhs per annum. 45. The Petitioners had applied under various Government Orders referred above for grant of financial assistance online and were issued e-pass. However, the State Level Screening Committee (SLSC) could not meet due to covid-19 pandemic and the Petitioners were given to understand that they were informed to be entitled for the amounts specified in the respective Government Orders. 46. In the counter affidavits filed, it was pointed out that the G.O.Ms.No.39, SW (EDN.), Department, dated 11.07.2022 was issued as there were several lapses noticed in the various community specific G.Os in vogue till that point of time i.e., the candidates were made to apply against limited number of seats earmarked under the scheme and discretion in the selections process, leading to less transparency and corruption. It is further stated that various other issues were also mentioned. 47. It is further mentioned that students should make an application online and based on the eligibility, an e-pass would be 116 issued. Thereafter, the State Level Screening Committee would be convened and only upon satisfaction of the Committee, sanction proceedings would be issued. It is further stated that in view of the lapses, no State Level Screening Committee meetings were conducted after 2019 and in the absence of sanction proceedings, the Petitioners cannot claim any financial assistance under the respective Government Orders. 48. Heard Sri Peddi Vijayabhaskar, Md.Saleem Pasha, learned counsel for the Petitioners and learned Government Pleader for Social Welfare, Government Pleader for Revenue for the Respondents. 49. The undisputed fact is that the Petitioners had applied for financial assistance under the respective G.O.s through online and e-pass was issued to them. Though, the counter affidavits specify lapses in the procedure of financial assistance under the respective G.Os and that the SLSC did not sanction any amounts to the Petitioners, there is no mention of denying the entitlement of the financial assistance to the Petitioners as per the parameters specified in the respective G.O.s. 50. Once the e-pass was issued to the applicants, the natural 117 consequence would be to consider the cases for sanction by the State Level Screening Committee (SLSC) and the fact that SLSC did not meet after 2019 could not be to the disadvantage of the applicants for financial assistance. It is not the case of the Respondents that the G.Os under which the applicants had applied were abandoned and the applicants are not entitled for consideration of their cases. In fact, the comprehensive G.O.Ms. No.39, dated 11.07.2022 was issued after taking note of all the community specific G.O.s existing as on that date, enhances the financial assistance by removing the limit on total claims in respective G.O.s and enhanced the financial assistance @100% of tuition fees for top 100 ranked Universities and 50% of tuition fees for Universities ranked between 101-200. 51. In that scenario, as the applicants had made applications for financial assistance under respective G.O.s and e-pass having been issued, the State Level Screening Committee (SLSC) was bound to post facto examine the cases of the applicants in terms of the respective G.O.s only. 52. Therefore, the writ petitions are disposed of with the following directions: 118 (i) Respondents are directed to constitute State Level Screening Committee under respective G.O.s in vogue prior to G.O.Ms No.39 dated 11.07.2022 and consider the cases of the applicants post facto for grant of financial assistance as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of the order. (ii) In the event the applicants are found to be eligible, the amounts shall be disbursed to the applicants within a further period of two months. (iii) No order as to costs.
